West Virginia DUI Defense: Why the Numbers, the 24 Cues, and the Testing Procedures Matter
Understanding the Evidence Behind a West Virginia DUI Charge — and How Attorney Ty Nestor Examines It
Every year, thousands of West Virginians encounter the criminal-justice system because of an allegation of driving under the influence of alcohol, controlled substances, or drugs. A DUI charge can affect a person's driver's license, employment, insurance, finances, family, and reputation.
But a DUI arrest is not a conviction.
A West Virginia DUI case is an evidence case. The State must prove the elements of the offense beyond a reasonable doubt, and the evidence used to establish impairment must be examined carefully. That is particularly important because law-enforcement officers are trained to recognize standardized indicators of impaired driving, while modern DUI prosecutions frequently rely upon breath, blood, hospital laboratory results, field-sobriety observations, toxicology, dash-camera footage, body-camera footage, and an officer's interpretation of a driver's conduct.

How Many DUI Cases Are There in West Virginia?
The exact number depends upon what is being counted — arrests, citations, charges, convictions, or arrests made during particular enforcement programs.

Those numbers should not be described as the total number of all West Virginia DUI arrests because the source specifically states that they are arrests made during grant-funded activities.
The West Virginia Division of Motor Vehicles also maintains a DUI-arrest/outcome system showing DUI arrests and case outcomes by county, with data beginning in 2021 and continuing through the current fiscal year.
The State has also reported that drug impairment has become a significant component of DUI enforcement. According to the West Virginia DMV, more than 30% of DUI arrests in West Virginia in 2024 involved drivers impaired by drugs, with two Governor's Highway Safety Program regions reporting 44%.
That development makes scientific and procedural scrutiny of DUI evidence increasingly important.
The 24 Driving Cues: What Officers Are Actually Trained to Look For
One of the most important things a DUI defense lawyer can do is understand what the officer was trained to observe.
The National Highway Traffic Safety Administration's standardized DWI-detection materials identify 24 driving cues associated with drivers whose blood-alcohol concentration was at or above .08%. The cues were developed from research involving hundreds of officers and more than 12,000 enforcement stops.
The 24 cues fall into four general categories:
- Problems maintaining proper lane position
- Speed and braking problems
- Vigilance problems
- Judgment problems
The research underlying the NHTSA materials found that particular combinations of cues were associated with increased probabilities of impairment. Importantly, however, these are investigative indicators, not mathematical proof that a particular driver was impaired.
That distinction matters.
An officer may testify:
“I observed several indicators of impairment.”
The defense question is:
Exactly what did the officer observe, under what circumstances, and does the actual evidence support the officer's characterization?
A lawyer should therefore obtain and examine the officer's training, report, body-camera footage, dash-camera footage, dispatch recordings, photographs, diagrams, and every available piece of evidence concerning the driving.
Standardized training does not eliminate individualized fact analysis.
A trained officer may know what cues he or she is supposed to look for. But the existence of a training manual does not establish that every observed behavior was caused by alcohol or drugs.
For example:
- Was the roadway curved?
- Was the pavement wet?
- Was there snow, ice, gravel, or debris?
- Was the vehicle avoiding an obstacle?
- Was the driver unfamiliar with the road?
- Was there construction?
- Was the driver looking for an address?
- Was there a mechanical problem?
- Was the driver tired?
- Was there a medical condition?
- Was the officer's description consistent with the video?
Those questions can substantially change the evidentiary meaning of the same driving behavior.
The First Defense: Was the Vehicle Stop Lawful?
Before addressing BAC, blood, field sobriety tests, or toxicology, the defense should ask why the vehicle was stopped.
A DUI investigation cannot simply be justified after the fact because the officer eventually developed a suspicion of impairment.
The circumstances preceding the stop matter.
The defense should examine:
- The reason for the stop;
- The precise traffic violation alleged;
- Whether the officer actually observed the violation;
- Whether the officer's report changed over time;
- Whether the dash camera supports the report;
- Whether dispatch information was accurate;
- Whether an anonymous or citizen tip supplied the basis for the stop;
- Whether the officer had reasonable suspicion or probable cause;
- Whether the officer unlawfully prolonged the traffic stop.

A suppression issue at the beginning of the encounter can affect everything that follows.
The Second Defense: Did the Officer Actually Establish Impairment?
West Virginia's DUI statute defines an “impaired state” in several ways, including being under the influence of alcohol, a controlled substance, another drug or inhalant, or a combination of substances, as well as having a blood alcohol concentration of .08% or greater.
This means that a DUI defense cannot always be reduced to:
“The BAC was below .08.”
Nor can the State necessarily prove every DUI simply by saying:
“The BAC was .08 or higher.”
The precise statutory theory matters.
A defense lawyer should determine whether the prosecution is proceeding on:
- alcohol impairment;
- per se alcohol concentration;
- drug impairment;
- combined alcohol and drug impairment;
- a crash-related theory;
- aggravated DUI;
- DUI resulting in injury or death; or
- another statutory enhancement.
The evidence required and the defenses available can differ substantially.
Field Sobriety Tests Are Evidence — Not an Automatic Conviction
West Virginia courts have recognized that psychomotor field-sobriety tests such as the walk-and-turn and one-leg-stand involve balance and divided attention and may be considered by a fact finder. In State v. Dilliner, the Supreme Court of Appeals discussed the evidentiary character of psychomotor field-sobriety testing.
But the circumstances surrounding the tests matter.
A defense examination should consider:
- footwear;
- roadway surface;
- lighting;
- weather;
- slope;
- age;
- physical condition;
- injuries;
- neurological or orthopedic conditions;
- medications;
- instructions;
- demonstrations;
- whether the officer properly administered the test;
- whether the officer accurately recorded the results; and
- whether the video contradicts the written report.
HGN requires special attention.
In State v. Dilliner, the Supreme Court held that HGN (Horizontal Gaze Nystagmus - "the follow my finger don't turn your head" - "you are turning your head - don't turn your head - just follow my finger" test) evidence is not admissible in a civil or criminal proceeding to show that a defendant drove under the influence unless there is specific expert proof establishing the scientific reliability of HGN evidence in the particular case. The Court further held that an officer's training in administering HGN does not itself establish the officer's expertise concerning its scientific reliability.
That makes HGN a particularly important evidentiary issue in an appropriate West Virginia DUI case.
The Chemical-Test Defense: West Virginia Has Specific Rules
West Virginia's statutory scheme imposes specific requirements concerning chemical testing.
Under W. Va. Code § 17C-5-4, implied consent applies to preliminary breath analysis and a secondary chemical test, but a warrant is generally required for a secondary blood test absent written consent.
Section 17C-5-6 also specifies who may withdraw blood and requires the use of a previously unused sterile needle and sterile vessel, adherence to accepted medical practices, and a nonalcoholic antiseptic for venipuncture.
These are not merely suggestions for a police officer to follow.
They provide defense counsel with concrete questions.
Who drew the blood?
Was the person:
- a physician;
- registered nurse;
- trained medical technician; or
- professional trained in phlebotomy at the place of employment?
What equipment was used?
Was the needle sterile?
Was the vessel sterile?
Was the specimen properly preserved?
What was used to clean the skin?
This question can be critical.
West Virginia's legislative rule, W. Va. C.S.R. § 64-10-8, establishes standards governing blood analysis. The rule has been active since April 1, 2022.
Among the requirements discussed in the controlling case law are restrictions concerning ethyl-alcohol antiseptics, collection procedures, laboratory methodology, and serum-to-whole-blood conversion.
The 1.16 Rule: Serum Is Not Automatically Whole Blood
This is one of the most important technical issues in hospital-blood DUI cases.
West Virginia law recognizes different measurement bases for alcohol concentration. Section 17C-5-8 provides that the determination may be expressed as grams of alcohol per 100 cubic centimeters of blood, grams per 210 liters of breath, or grams per 86 milliliters of serum.
The West Virginia regulation provides a specific conversion:
Serum alcohol ÷ 1.16 = whole-blood alcohol.
The West Virginia State Police Laboratory Field Manual provides an example in which a hospital serum result of 256 mg/dL is converted to .256 g/dL and then divided by 1.16, producing approximately .22% blood alcohol by weight. The manual specifically notes that WVSP toxicology reports themselves do not require the user to perform that calculation because the laboratory report incorporates the appropriate calculation.
Why does this matter?
Serum and whole blood are not interchangeable measurements.
In Frazier v. Corley, the Supreme Court of Appeals addressed a hospital blood-serum result and the requirement to convert the serum concentration to a whole-blood concentration. The Court recognized that § 64-10-8.2(d)'s 1.16 conversion factor is part of the governing legislative rule.
In Frazier v. Powers and Frazier v. Burcker, the Supreme Court reaffirmed the importance of compliance with § 64-10-8 and held that, absent evidence that a diagnostic blood test complied with the regulation, the Office of Administrative Hearings was justified in discounting the accuracy of the blood-test result for purposes of an aggravated-DUI enhancement.
That is a significant defense principle:
The existence of a number in a hospital record does not end the inquiry.
The defense should ask:
- What exactly was tested?
- Was it whole blood or serum?
- What units were used?
- Was the result converted?
- Was the conversion performed correctly?
- Was the blood collected under the applicable standards?
- Was a nonalcoholic antiseptic used?
- Who drew the blood?
- What container was used?
- Was the specimen properly preserved?
- What laboratory performed the testing?
- What methodology was used?
- Is there sufficient documentation establishing compliance?
Timing of Blood Testing: Two Hours for Alcohol, Four Hours for Drugs
Timing is another major issue.
Under W. Va. Code § 17C-5-8(g), for the chemical-test evidentiary provisions of that statute:
- an alcohol sample must be taken within two hours of arrest; and
- a controlled-substance or drug sample must be taken within four hours of arrest.
The defendant's statutory right to demand an independent test is similarly addressed in § 17C-5-9, which provides a two-hour period for alcohol testing and a four-hour period for controlled substances or drugs.
This creates a critical timeline for defense lawyers.
A DUI investigation should therefore be reconstructed minute-by-minute:
Time of alleged driving → time of crash → time officer arrives → time of contact → time PBT → time arrest → time warrant/consent → time hospital arrival → time blood drawn → time specimen received → time laboratory analysis.
A seemingly small discrepancy can become important when the State attempts to connect a later biological measurement to the defendant's condition at the time of driving.
What Happens When There Is a Crash?
Crash cases require special scrutiny because medical personnel may draw blood for treatment independently of law enforcement.
West Virginia's DUI paperwork specifically asks whether a blood sample was taken for medical treatment, including a crash, and separately asks for the time of the blood draw, the person who drew it, whether the Blood Draw Affidavit was completed, and whether a CDDP blood kit was used.
The form used for the person conducting a DUI blood draw — DMV-314A — is a sworn Blood Draw Affidavit. It asks the affiant to attest that he or she is medically trained and authorized to draw blood and that the blood was drawn in accordance with West Virginia law, regulations, and facility procedures for submission for chemical analysis.
This creates an important distinction:
Medical blood draw versus law-enforcement DUI blood draw
A hospital may draw blood because the patient needs medical treatment.
That does not necessarily mean the hospital was conducting a law-enforcement DUI chemical test.
Consequently, defense counsel should determine:
- Why was the blood drawn?
- Who requested it?
- When was law enforcement involved?
- Was the sample collected for treatment or forensic testing?
- Was law enforcement seeking to convert a medical diagnostic result into DUI evidence?
- Was the required affidavit completed?
- Was the proper testing procedure followed?
- Was the skin disinfected with an alcohol-containing product?
- Can the State establish the chain of custody?
- Can the State establish compliance with § 64-10-8?
The distinction became important in Frazier v. Corley, where the Supreme Court examined whether the evidence demonstrated compliance with the applicable blood-testing standards.
Drug DUI Requires More Than Finding a Drug
Drug DUI cases present a different evidentiary problem.
The mere presence of a drug or metabolite does not necessarily establish that the substance actually impaired the driver's ability to operate a motor vehicle at the relevant time.
West Virginia law recognizes multiple categories of impairment, including controlled substances, other drugs, and combined alcohol/drug impairment.
Consequently, a defense should examine:
- What substance was detected?
- Was the substance active or merely a metabolite?
- What concentration was detected?
- Is there an established impairment threshold?
- What is the pharmacological effect of the substance?
- When was it consumed?
- Was it prescribed?
- Was the driver tolerant to the medication?
- Was the driver taking it as directed?
- Could another medical condition explain the observed behavior?
- Could fatigue, injury, stress, or trauma explain the officer's observations?
- Was the blood drawn within the four-hour statutory period?
- Was the officer qualified to request the drug blood test?
West Virginia law now specifically requires law-enforcement training in recognizing impairment from controlled substances and other drugs. An officer who has not completed the required minimum training may not require a person to submit to a secondary blood test for purposes of determining controlled-substance or drug concentration.
That makes the officer's training record potentially important discovery in a drug-DUI prosecution.
The Lactated Ringer's Issue in Crash-Related DUI Blood Tests
Was the Blood Sample Drawn After the Patient Received an IV?
Crash-related DUI cases present a special evidentiary problem that does not necessarily exist in an ordinary roadside DUI investigation.
A seriously injured person may arrive at an emergency department and immediately receive medical treatment, including intravenous fluid resuscitation. Lactated Ringer's solution (LR) is one of the commonly used resuscitation fluids in emergency medicine. Trauma literature specifically identifies saline and Ringer's lactate among the fluids used to maintain intravascular volume after hemorrhagic shock.
That creates an important question for DUI defense counsel:
Where, exactly, was the blood specimen obtained in relation to the IV line, and had IV fluids already been administered?
This is not a minor medical-record detail. It can become a significant part of the forensic examination of a crash-related blood-alcohol result.
Lactated Ringer's does not contain ethanol
The defense should be precise about this point.
Ordinary Lactated Ringer's solution is not an alcohol-containing IV fluid. Therefore, the argument should not simply be that “Lactated Ringer's puts alcohol into the bloodstream.”
Instead, the relevant scientific questions concern specimen dilution, specimen contamination, sampling location, timing, and the analytical method used to measure ethanol.
Published trauma literature explains that intravenous resuscitation fluids can dilute blood constituents, including alcohol, and that the effect can be particularly relevant when blood is collected from a vein affected by an IV infusion. The literature specifically describes the possibility of an appreciable dilution effect when fluids are administered into a vein in the hand and blood is subsequently collected from an elbow vein on the same arm.
That means a defense lawyer should obtain the complete emergency-department record rather than simply accepting the BAC appearing on a laboratory report.
The Critical Question: Where Was the Blood Drawn?
Suppose a person is involved in a serious collision.
The sequence may look like this:
Crash → EMS treatment → IV established → Lactated Ringer's administered → emergency-department treatment → blood drawn → hospital laboratory reports ethanol concentration → police obtain the result → DUI prosecution.
The defense needs to reconstruct that sequence precisely.
Questions include:
- Which arm received the IV?
- Which vein was used?
- When was the IV started?
- What fluid was administered?
- How much fluid was administered?
- At what rate?
- When was the IV stopped?
- Was blood drawn from the same arm?
- Was blood drawn proximal or distal to the IV?
- Was the IV line itself used for the blood draw?
- Was the IV line flushed?
- Was blood discarded before the specimen was collected?
- Was a tourniquet used?
- What was the patient's hematocrit?
- What was the patient's hemoglobin?
- What was the patient's serum alcohol concentration?
- What analytical method did the hospital use?
- Was the test an enzymatic assay or gas chromatography?
- Was the sample subsequently subjected to a forensic confirmatory analysis?
Those questions can be especially important when the blood result is being used to establish a statutory BAC threshold.
Dilution and Contamination Are Different Problems
These concepts should not be confused.
Dilution
If IV fluid enters or substantially mixes with the specimen, the specimen may contain a different concentration of blood constituents than the patient's circulating blood.
Published trauma research explains that resuscitation fluids can dilute blood constituents, including alcohol.
Contamination
Contamination presents a different question: whether material associated with the collection process entered the specimen and affected the analytical result.
For example, West Virginia law specifically requires that blood collected at the direction of law enforcement be obtained with a previously unused and sterile needle and sterile vessel and otherwise in strict accordance with accepted medical practices.
West Virginia's statutory scheme also requires a chemical analysis used for the statutory presumptions to be performed according to the methods and standards approved by the West Virginia State Police Forensic Laboratory.
Consequently, a defense lawyer should not merely ask:
“What was the BAC?”
The better question is:
“Was the specimen representative of the defendant's circulating blood at the legally relevant time, and can the State establish that through reliable scientific evidence?”
What About Lactate and LDH?
There is another scientific issue that sometimes arises in trauma cases.
Trauma, shock, and tissue injury can produce elevated lactate and lactate dehydrogenase (LDH). Because some hospital ethanol assays use enzymatic reactions involving NAD+/NADH, questions have been raised about whether very high lactate and LDH concentrations can interfere with certain ethanol assays.
A published study specifically investigated this issue in emergency-department trauma patients. The researchers identified patients with elevated lactate and LDH and subjected positive enzymatic ethanol results to confirmatory gas-chromatography testing. In that study, the researchers concluded that the data did not support the proposition that elevated LDH and lactate produced false-positive serum ethanol results in live emergency-department patients.
That is important because a responsible DUI defense should not overstate the science.
The issue is not:
“Trauma automatically creates a false BAC.”
It does not.
The proper defense question is:
“What analytical method was used, what was the patient's clinical condition, what were the specimen-collection circumstances, and was the reported ethanol concentration independently confirmed?”
That is a scientifically defensible inquiry.
Why the Laboratory Method Matters
Hospital laboratories may use methods different from those used by a forensic laboratory.
A defense lawyer should therefore obtain the hospital laboratory's:
- test name;
- analytical methodology;
- instrument;
- manufacturer's documentation;
- calibration information;
- quality-control records;
- reference range;
- specimen type;
- specimen collection requirements;
- specimen-processing records;
- result units;
- laboratory notes; and
- confirmatory-testing information.
If the result was generated by an enzymatic assay, the defense should determine whether a more specific forensic method, such as gas chromatography, was performed.
The distinction can matter because the method used to generate a medical diagnostic result may not be identical to the methodology used by a forensic laboratory for evidentiary alcohol analysis.
The IV Record Should Be Obtained in Every Significant Crash Case
For this reason, the DUI defense lawyer should obtain the complete emergency-medical record, not merely the page containing the BAC.
That should include:
- EMS records;
- emergency-department records;
- nursing notes;
- medication-administration records;
- IV-fluid administration records;
- fluid type;
- fluid volume;
- infusion start and stop times;
- IV location;
- blood-draw location;
- blood-draw time;
- laboratory accession time;
- laboratory testing time;
- specimen type;
- serum versus whole blood designation;
- laboratory methodology;
- quality-control records where appropriate;
- toxicology records;
- blood-bank records where applicable; and
- all police documentation concerning acquisition of the medical records.
The objective is to reconstruct exactly what happened to the specimen before anyone ever put a BAC number on it.
The Timing of the IV and Blood Draw Can Be Critical
Consider a hypothetical crash:
6:00 p.m. — Collision
6:10 p.m. — EMS arrives
6:20 p.m. — IV established
6:25 p.m. — Lactated Ringer's begins
6:50 p.m. — Patient arrives at hospital
7:05 p.m. — Additional IV fluid administered
7:15 p.m. — Hospital blood specimen collected
7:30 p.m. — Hospital reports serum ethanol
That timeline raises substantially different forensic questions from a case in which:
6:00 p.m. — Collision
6:05 p.m. — Blood collected before IV treatment
The defense should therefore obtain the records necessary to determine which situation actually occurred.
West Virginia's Blood-Testing Requirements Make the Collection Process Important
West Virginia law provides that, when blood is withdrawn at the request and direction of law enforcement for determining alcohol or drug concentration, only specified medically trained personnel may perform the draw, and the statute requires a previously unused sterile needle and sterile vessel and compliance with accepted medical practices.
West Virginia law also provides that chemical-test evidence is admissible under § 17C-5-8 only if the statutory requirements are satisfied, including the applicable timing requirements. For alcohol, the sample must be taken within two hours of arrest; for controlled substances or drugs, the statutory period is four hours.
Thus, in a crash case involving hospital treatment, defense counsel should create a medical-treatment timeline and a forensic-testing timeline and compare them.
The Right Defense Argument Is Not “The IV Created Alcohol”
The strongest argument is more precise.
A lawyer should not tell a court that ordinary Lactated Ringer's solution contains ethanol or automatically produces a falsely elevated BAC.
Instead, the defense can argue where supported by the evidence:
The State must establish that the biological specimen it relies upon was properly collected, was representative of the defendant's circulating blood, was not materially affected by the administration of IV fluids or the method of collection, and was analyzed using a reliable and legally compliant method.
That argument is much stronger because it focuses on proof and scientific reliability rather than speculation.
And when the case involves a hospital serum result, the defense must separately determine whether the result was properly converted to the statutory whole-blood equivalent under West Virginia's governing rules.
Looking Behind the Number
A crash can produce a complicated medical environment:
trauma + blood loss + IV fluids + emergency treatment + medications + multiple blood draws + hospital laboratory testing + police acquisition of medical records.
A DUI prosecution may ultimately reduce all of that to one number printed on one laboratory report.
Experienced DUI defense requires asking what happened before that number existed.
That is where the medical records, IV administration records, specimen-collection documentation, laboratory methodology, statutory requirements, and expert review can become critical.

In a crash-related DUI, do not simply look at the BAC. Look at how the BAC was created, measured, collected, converted, and reported.
The Preliminary Breath Test Is Not the Same Thing as the Final Chemical Test
West Virginia law distinguishes the preliminary breath analysis from the secondary chemical test.
Under § 17C-5-5, the preliminary breath analysis (the hand held device performed by the officer at the stop) is intended to help the officer determine whether an arrest should be made. The statute states that its results are to be used solely for guiding the officer in deciding whether an arrest should be made. Therefore, the numerical BAC result from this testing is precluded from evidence against you at trial. Only the Secondary Chemical test of your Breath or Blood can be admitted and certain procedures must be observed by the investigating officers before that evidence can be admitted as well.
That means the defense should determine exactly what test the State is offering and for what purpose.
Questions include:
- What device was used?
- Was it approved?
- Was it properly operated?
- Was it properly maintained?
- Was the officer trained?
- Was the test performed as required?
- Was sufficient time allowed before testing?
- Was there anything in the defendant's mouth that could affect the result?
- Is the State confusing a preliminary screening result with a statutory secondary chemical test?
Checkpoint and Roadblock Defenses
A DUI case can also originate at a sobriety checkpoint.
West Virginia law recognizes constitutional limitations on checkpoints. The Nestor Law Office has previously discussed West Virginia checkpoint requirements and cited Carte v. Cline, 194 W. Va. 233 (1995) in connection with checkpoint procedures.
Defense counsel should investigate:
- advance notice;
- predetermined location;
- neutral selection procedures;
- supervisory approval;
- lighting;
- officer safety;
- motorist safety;
- availability of an alternate route;
- whether the checkpoint was operated according to established policy; and
- whether the actual checkpoint operation matched the written policy.
A constitutionally defective checkpoint can create a suppression issue before the State ever reaches the question of impairment.
Other DUI Defenses That May Apply
There is no single “West Virginia DUI defense.” The appropriate defense depends upon the facts.
Potential issues include:
1. No proof the defendant was driving
The State must establish the required connection between the defendant and operation of the vehicle.
2. Insufficient proof of impairment
The defense can challenge whether the total evidence actually establishes impairment.
3. Illegal stop
Evidence resulting from an unconstitutional stop may be subject to suppression.
4. Unlawful extension of a traffic stop
Even a lawful traffic stop can present Fourth Amendment issues if unnecessarily prolonged.
5. Lack of probable cause for arrest
A secondary chemical test is tied to a lawful arrest and the statutory requirements.
6. Invalid warrant
Where a blood draw is conducted pursuant to a warrant, the warrant and affidavit should be examined carefully.
7. Lack of proper consent

10. Alcohol contamination
The use of an alcohol-containing antiseptic can create an important evidentiary issue.

The 1.16 conversion must be considered when a serum result is used.

The two-hour alcohol and four-hour drug provisions must be analyzed.
13. Chain of custody
The State should be able to account for the specimen.
14. Laboratory reliability
The defense can examine the laboratory method, quality controls, calibration, documentation, and analyst qualifications.

Body-camera and dash-camera footage can contradict an officer's written characterization.

A valid prescription does not automatically establish sobriety, but neither does the presence of a prescribed medication automatically establish impairment.

Depending upon the facts, the defense may investigate whether the defendant was still absorbing alcohol when the driving occurred and whether the later test reflects a higher concentration than existed while driving.

A crash itself does not automatically prove impairment.

Hospital records should be carefully distinguished between diagnostic testing and forensic DUI testing.

West Virginia recognizes an arrested person's statutory right to demand a test. In Frazier v. Talbert, the Supreme Court discussed the consequences when a requested blood test is not provided or the testing process is incomplete.

The more important question can be:
Did the evidence actually establish impairment in the manner required by West Virginia law?
A trained officer may correctly recognize certain driving cues. A blood test may accurately report the concentration of a substance in a particular specimen. A hospital may accurately perform a medical test.
And yet the State can still have difficulty proving the ultimate criminal case if:
- the stop was unlawful;
- the arrest lacked probable cause;
- the field testing was improperly administered;
- the scientific evidence lacks a proper foundation;
- the wrong specimen was used;
- the serum result was not properly converted;
- the blood collection procedure was defective;
- the specimen was contaminated;
- the chain of custody is deficient;
- the test was outside the statutory timing requirements;
- the substance detected does not establish impairment;
- the video contradicts the officer;
- or the evidence fails to establish the defendant's impairment at the legally relevant time.
That is why experienced DUI defense requires more than simply looking at the number printed on a laboratory report.
It requires looking behind the number.
